Henry N. Novoselsky

Henry Novoselsky represents individuals and banks, trust companies and corporate fiduciaries in contested trust and estate matters, such as will and trust contests, trust administration, enforcement, construction and reformation, probate citations, accountings and supplemental proceedings, breach of fiduciary duty claims and contested guardianship proceedings.

Henry has practiced civil litigation in Illinois and Federal trial and appellate courts for over 50 years. He has been instrumental in shaping the law of Illinois, appearing before the Illinois Supreme Court, United States Courts of Appeals and the Illinois Appellate Court in matters of first impression, including cases settling the scope of attorney malpractice liability in drafting inter vivos, living trusts (198 Ill.2d 439), survival of goodwill attendant to a physician’s clinic (125 Ill. App.3d 74), whether a buyer’s purchase order indemnification clause becomes part of the parties’ contract (882 F.2d 1254) and the requirements for an enforceable covenant not to compete (295 Ill. App.3d 935).

Henry has acted as a court-certified mediator in the State of Illinois, Circuit Court of Cook County, Chancery Division Mediation Program, mediating trust and other disputes. He has also served as an Administrative Law Judge for the Illinois Department of Revenue and as a Hearing Examiner for the Illinois Commerce Commission.
